Overcome language barriers: the Works Councils Act in English!

Many Dutch Works Councils operate in an international environment, in a group of companies worldwide and maybe even have English as the working language within the company. These settings may be challenging to adequately effectuate the participatory rights of the Works Council.

All the more, if the decision-making process of decisions that may directly or indirectly significantly affect the Dutch organisation takes place at multiple levels, in and outside the Netherlands. It is helpful if the involved directors are familiar with the Works Councils Act and the rights that works councils have in the Netherlands. Unfortunately, this is not always the case. And it does not help that the relevant Act, Wet op de Ondernemingsraden (WOR), is in Dutch.

For internationally operating Works Councils and their directors, it is helpful to know that the Sociaal-Economische Raad (SER) publishes an English translation of the Works Councils Act. The lastest version dates of January 2023 and does not include some minor changes to the Act on 18 February 2023.[1] Wybenga Advocaten has updated the translation of the SER and you can find this translation here. This tool may assist in getting everyone ‘up to par’ with the Dutch legal framework.

Overwin taalbarrières: de WOR in het Engels!

Veel ondernemingsraden opereren in een internationale omgeving, in een groep van wereldwijde bedrijven. Soms is de werktaal binnen het bedrijf Engels. In deze setting kan het uitdagende zijn voor een ondernemingsraad de medezeggenschapsrechten op een adequate manier te vervullen.

Dit speelt des te meer, als het besluitvormingsproces van besluiten die direct of indirect een wezenlijke invloed hebben op de Nederlandse organisatie plaatsvindt op verschillende niveaus, binnen en buiten Nederland. Het is behulpzaam als de betrokken managers bekend zijn met de Wet op de Ondernemingsraden (WOR) en de rechten van Nederlandse ondernemingsraden. Helaas is dit niet steeds het geval. En het helpt daarbij niet dat de WOR in het Nederlands is.

Voor internationaal opererende ondernemingsraden en hun gesprekspartners, is het handig te weten dat de Sociaal-Economische Raad (SER) een Engelse vertaling van de WOR heeft gepubliceerd. De laatste versie dateert van januari 2023 en bevat niet de laatste (kleine) wijzigingen in deze wet van 18 februari 2023.[1] Wybenga Advocaten heeft de vertaling van de SER geactualiseerd. Je kan deze vertaling hier vinden. Dit kan eraan bijdragen om iedereen ‘up to par’ te krijgen met het juridisch kader in Nederland.
